Legal Provisions for Seatbelt in India

It is mandatory to wear seatbelt by the driver and passengers being carried in a motor vehicle. The State Government may by Gazette Notification exclude this provision for transport vehicles to carry standing passengers.

According to Section 194B of the Motor Vehicles Act, 1988 driving a motor vehicle or carrying passengers without wearing seatbelt shall be punishable with fine of one thousand rupees.

Similarly, if a child not having attained age of fourteen years is not secured by a safety belt or a child restraint system shall be punishable with a fine of one thousand rupees.
