Important Directions

Supreme Court Committee on Road Safety

The Hon'ble Supreme Court, vide its Order dated 22nd April 2014 in Writ Petition (C) No 295 of 2012 had constituted a Committee under the Chairmanship of Hon'ble Mr. Justice KS Radhakrishnan, Retired Judge, Supreme Court of India to measure and monitor on behalf of the Court the implementation of various laws relating to motor vehicles. The Committee coordinates with the all the State Governments and UTs to monitor the road safety scenario. Based on the institutional framework for road safety, road crashes, fatalities, measures being taken by the states etc. the Committee directs the States for taking further initiatives to improve the scenario. The States accordingly submit quarterly reports to the Committee along with the action taken report upon the directions given to the State. Some of the important directions given by the Committee to the State of Rajasthan are depicted in the subsequent section.

Road Safety Fund

The Committee reiterates that there should be separate State Road Safety Fund to be operated by the Transport Department so as to ensure steady flow of funds. The Committee accordingly again directs the State to establish a separate dedicated State Road Safety Fund, as directed vide letter dated 17.02.2016, by 30th September, 2016 and credit a certain percentage of compounding fees & fines collected from traffic law violators to the Fund in addition to the grants in aid.

Road Safety Audit

The Committee reiterates its direction dated 28.05.2016 that the State should ensure that the construction work of any road costing above rupee ten crores is commenced only after road safety audit is conducted, by a third party, at design stage and recommendations of the design stage auditor are implemented. Road Safety Audit should be conducted at construction and operational stages also.

Training and Capacity Building

The Committee directs that the Lead Agency should prepare a separate Training Calendar for PWD, NHAI or MoRTH (PIU) and any other road owning/managing agency in the State, in consultation with them, for training of adequate number of highway engineers belonging to the respective road owning/managing agency and ensure that the engineers are trained in road safety and that their services are utilized as master trainers. A copy of the Calendar may be sent to the Committee.

Removal of Encroachment / Street Vendors

The State should take action taken in accordance with Street Vendors (Protection of Livelihood & Regulation of Street Vending) Act 2014 for removal of illegal encroachments on pedestrian path and action taken report should be sent to the Committee by 30th September, 2016.

Black Spots

Each of the Protocols for Black Spots, prepared by the nine road owning/managing agencies in the State, namely, PWD, NH(PWD), RO(NHAI), RIDCOR, RSRDCC Ltd, UDH, GREF, BRO AND RIICO should also have provision for joint inspection of the identified sites by Highways Engineers, Police Officials and Road Safety Expert(s), mandatory consultation with Road Safety Expert(s) and obtaining his/her recommendations on the required remedial measures in respect of each identified site. The output of the identification exercise should be a list of black spots in the district prepared jurisdiction wise (i.e. according to the jurisdiction of the road owning/managing agencies in the district). The Protocols should also provide time line for rectification of black spots which should include implementation of the recommendations of road safety expert referred to above and post rectification evaluation of each of those identified sites in a fixed timeframe. A mechanism for ensuring that each road owning/managing agency adheres to the timeline for each activity prescribed in the Protocols every year should also be provided for.

The State is directed to revise the Action Plan in accordance with the directions in para 2.i.(e) above and submit the same directly to MoRTH with a copy to the Committee.

Road Safety Fund

The committee noted the Dedicated Road safety Fund Regulations 2017 notified by the State on 3rd April 2017 and observed that there is no clarity whether the Dedicated Road Safety Fund is lapsable or non-lapsable. The Committee directed that the State should ensure that the Dedicated Road Safety Fund is a non-lapsable Fund as desired by the Committee vide its letter no 16/2016/CoRS dated 24th November, 2016.

Black Spots

The committee noted that all road owning agencies in the state have finalized and issued the protocol for Black spots and desired that all road owning agencies in the States should now follow the Protocol finalized by them.

The Committee noted that the Police Department have identified 963 black spots in 2017 and desired that the concerned agencies should take further action as per their protocol for Black Spots.

Suspension of Driving License

The Committee noted that its directions dated 18.08.2016 and 17.11.2016 regarding suspension of driving licenses for specified traffic violations are not being strictly implemented. The committee noted that the state has taken action for suspension of licenses in only about 8.4% cases (9.7 thousand cases recommended for suspensions out of 115 thousand traffic violations detected in first quarter of 2017) and directed the state to strictly implement its directions dated 18.08.2016 and 17.11.2016.

Automated Driving Testing Tracks

The committee noted that on account of low fee prescribed in the Central Motor Vehicle Rules, setting up of automated driving tracks are economically not viable and that the State Government has decided to set up 12 automated driving tracks in 12 RTO offices located in district headquarters from its own funds. The remaining 21 district head quarters will be covered later. The Committee directed the State to fix a timelines for completion of 12 automated driving tracks and intimate the Committee. The setting up of 12 automated driving tracks should also be included in the Action Plan for 2017 - 18.

Trauma Care

The Committee noted the action taken by the State regarding emergency trauma are and directed the State to indicate what the State proposes to do in 2017-18 for strengthening the emergency trauma care facilities and services.

District Road Safety Committees

The Committee feels that suggestions made by the Chairman, NHAI will help to bring closer coordination between States and NHAI. The Committee, therefore, requests the State Govts. to make the Regional Officer and the Project Officer of the respective areas of NHAI members of the State Road Safety Council and District Road Safety Committee respectively.

Implement the State Road Safety Policy

The Committee directed that all nodal Departments of the State should be asked to prepare a plan of action for 2018 -2020 for implementing and fulfilling the policy pronouncement(s) in the Rajasthan Road Safety Policy pertaining to their Department. Lead Agency should coordinate with all nodal Departments and submit a report on action taken by them to the Committee.

The Committee noted that parking of trucks and other heavy vehicles on highways and other roads is a major cause of accidents and fatalities in the State and directed the State to provide rest areas and way side amenities on highways and other roads.

Need to sensitize staff and officers of stakeholder departments

The Committee observed that while there was a negligible reduction of 0.4%, 0.2% and 1.2% in road related fatalities in 2016, 2017 and 2018 over the previous years, the road related fatalities increased by 4.4% in January - March, 2019 period over the corresponding period of the previous year. The Committee expressed its displeasure stating that inspite of number of meetings with Government of Rajasthan to reduce road related morbidity and mortality, there has not been perceptible reduction in road related fatalities. Result oriented action at ground level does not appear to have taken place. The Committee was deeply disappointed that the State did not make serious efforts to reduce road accidents and fatalities. The Committee, therefore, found it necessary to meet the Chief Secretary in order to emphasize the highest level the need to make an all out and coordinated effort by all concerned Departments and other stakeholders in the State to reduce road accident and fatalities. The Chief Secretary assured the Committee that staff and officers of all stakeholder Departments will be sensitized to road safety issues.

Lead Agency

The Committee noted that an officer of the rank of Additional Commissioner has been appointed to head the Lead Agency though his charge also includes Planning and Development apart from Road Safety. The Committee said that though the Committee's directions dated 24th November, 2016 stipulate appointment of head of Lead Agency on full time basis, it would like to observe the working of the Lead Agency for some time.

Road Safety Action Plan

The Committee also desired that the District Road Safety Plans should be prepared in consultation with Transport, Police, Engineering and Emergency Care Departments and submitted to the District Road Safety Committees (DRSCs). The District Road Safety Plans should reflect vulnerable road segment wise observation on ground level road safety issues and vulnerable road segment wise planning and the proposed action by different stakeholder Departments.

Street lights on NHs, SHs and MDRs

The State representatives said that often accidents happened on NHs and SHs in rural areas where there is no street light because the Gram Panchayats and other Local Self Governing Bodies are not able to pay for the electricity bills. The Committee said that Tamil Nadu has reduced accidents during night time by ensuring properly lit street lights on NHs and SHs during night time. The Committee desired that the State should find a way out to put street lights on NHs and SHs in rural areas and to keep them lit/illuminated during night time and ensure patrolling at vulnerable locations to avoid such accidents. NHAI and State officials should sit together to find a solution of lighting on the National Highways during night time.

District Road Safety Committees

a) The Committee noted that the State has issued directions to all District Magistrates on 23.01.2019 to hold quarterly meetings of DRSCs. The Committee desired that the Lead Agency should monitor the implementation of these directions by District Magistrates and the targets and strategies should be discussed in these meetings. The Lead Agency should submit report to the Chief Secretary on quarterly basis.
b) The State should ensure that each DRSC analyzes the data of the district and identifies all vulnerable road segments (whether they fall within the definition of black spots or not) and takes specific measures to address the vulnerability issues on a regular basis.
c) The Lead Agency should also regularly monitor the reduction of fatalities in each district and ensure that the district authorities take necessary steps to achieve the targets set for them.

Crash Investigations

The Committee noted that in pursuance of Committee's directions dated 26.09.2018, the State Government has issued directions that every road accident involving death or major injury will be investigated by a team comprising of a representative each from the Department of Transport, Police and PWD. The Committee said that the State is required, under Section 135 of Motor Vehicles Act, to frame a scheme for carrying out an in-depth study of causes of motor vehicle accidents and also wayside amenities, truck parking facilities etc. The Committee desired that such a scheme should be prepared by the State, if necessary, with the assistance of reputed Research Institutes having domain expertise by 30th September, 2019. A copy of the scheme notified by the State should be submitted to the Committee.

Training to the staff of the Lead Agency

The State representatives said that they would impart road safety training to the staff of the Lead Agency in the month of September, 2019. The Committee directed the State to impart training to staff of the Lead Agency according to the course outlines/curriculum sent with Committee's letter dated 26.09.2018.

Highway Patrolling

A) The Committee noted the State Police has 100 highway patrol vehicles, 80 interceptors and 4 crash labs for city areas. State has sanctioned Rs, 8.85 crore for establishing Intelligent Traffic Management system for Jaipur - Bhilwara section to check over speeding from Road Safety Fund
B) The Committee noted that at present, the State does not have Highway Patrol. The Committee said that National and State Highways together accounted for 57% of total fatalities in 2017 (NHs-39% & SHs-18%) in the State. The Committee directed that the State should take following action:
a) Set up Highway Patrol along all accident prone stretches of the National and State Highways in the State and indicate timeline for setting up the same.
b) Set annual targets to reduce fatalities due to over speeding on National Highways and State Highways under intimation to the Committee.
c) Acquire interceptor vehicles for highways under intimation to the Committee and use them not only as first responders but also to prevent over-speeding on NHs & SHs.
d) Use other means for checking the speed such as time taken by a vehicle to travel between 2 points of monitoring e.g. 2 toll plazas.

Procurement of equipment to detect traffic violations

The Committee noted that the State has not assessed its requirements as per BPR&D norms. The Committee directed that the State should assess its requirement of equipment as per BPR&D norms and set annual targets for their procurement so as to reach BPR&D norms for equipment within the next 5 years.

Training of personnel and maintenance of equipment

The Committee noted that the State gives training in handling equipment after the purchase of new technology equipment from time to time. Training is included in foundation course of newly recruited Rajasthan Police Constables. The Committee desired that the State should confirm that all the personnel presently handling the equipments have been trained and that satisfactory arrangements/AMC for maintenance of equipment in all districts has been made

Barriers on hilly roads, near water bodies and other vulnerable locations

A) The Committee noted that the State has identified 165 locations where either new barriers are required or the existing barriers are required to be replaced and that the State has set year wise targets to provide new barriers or replace existing barriers. The Committee desired that the Lead Agency should ensure that the stakeholder Departments make necessary budget provision in respective years and set aside the required funds for the purpose. The Lead Agency should regularly monitor and ensure that these targets are achieved. The Committee also desired that the State should confirm that the new or replaced barriers will be IRC standards compliant.
B) The Committee also desired that the arrangements may be made by the State and NHAI for periodic maintenance of the crash barriers to ensure that they remain compliant with IRC standards and it should be intimated to the Committee.

Maintenance of bridges

a) The Committee noted that the State has identified 119 unsafe bridges (out of a total of 1158 bridges) which are required to be repaired/replaced to make them conform to IRC standards. The Committee also noted that the State has set year wise targets for repair/replacement of unsafe bridges so as to make them conform to IRC standards. The Committee desired that the Lead Agency should ensure that the stakeholder Departments make necessary budget provision in respective years and set aside the required funds for the purpose. The Lead Agency should also regularly monitor and ensure that these targets are achieved. The Committee also desired that the State should confirm that the new or repaired/replaced bridges will be IRC standards compliant.
b) The Committee also desired that the arrangements may be made by the State and NHAI for periodic maintenance of the bridges to ensure that they remain compliant with IRC standards and the same should be intimated to the Committee.

Audit of the roads most prone to accidents

a) The Committee noted that the State has identified 262 roads where accidents occur the most which are required to be audited. The Committee also noted that the State has set year wise targets for audit of these 262 roads. The Committee desired that the Lead Agency should ensure that the stakeholder Departments make necessary budget provision in respective years and set aside the required funds for the purpose. The Lead Agency should also regularly monitor and ensure that these targets are achieved and audit recommendations are implemented on ground.
b) The Committee also desired that the State should fix a timeframe for identification of all vulnerable road segments (whether they fall within the definition of black spots or not) where accidents occurred the most in 2017 and 2018 on all roads including the above 262 roads. The State should fix a timeframe for conducting road safety audit of all vulnerable road segments so identified.
c) The Committee also desired that the timelines be drawn by the State and NHAI not only for initiation and completion of audit, but also for implementation of the recommendations of the audit under intimation to the Committee.

Over loading of school buses and 3-wheelers

a) The Committee noted that the State Transport Department had issued detailed Bal Vahini Scheme and Education Department had also reinforced the scheme.
b) The Committee directed that the carrying capacity of school buses and 3-wheelers which transport school children should be displayed both inside and outside the transport vehicles. The Committee also directed the State to take appropriate action under the law against all school buses including school owned/managed/operated transport buses and 3-wheelers carrying more school children than the prescribed carrying capacity. Action taken against such vehicles for this specific offence should be intimated to the Committee.

Driving of motorized vehicles by the under-age students

a) The Committee noted that Joint Director (Education) compliance with the Committee's directions. The Committee also noted that the State Police conducted special intensive enforcement campaign from 21 to 31 March, 2019 and has noted details of challans issued during the special intensive enforcement campaign.
b) The Committee directed that the schools should be actively involved in ensuring that under-age students do not drive motorized vehicles to reach the school and appropriate action under the law should be taken against the owners who allow their vehicles to be driven by underage students on a regular basis. Action taken against the owners of such vehicles should be intimated to the Committee.

Status of Ambulances

The Committee noted that all paramedics deployed in 108 ambulances are trained in EMT (Emergency Medical Technician) and are equipped with necessary equipment.

Mapping of Ambulances

a) The Committee noted that all 108 ambulances have been integrated with automatic vehicle location and tracking system, GIS and GPS for mapping/locating the ambulances and accessed by common emergency number 108.The State officials stated that private ambulances are not under the control of the State Government.
b) The Committee said that the State needs to consider mapping private ambulances also so that they can be accessed by one common emergency number. The State should also intimate as to how the State proposes to ensure that all ambulances, both public and private, are accessed by one common emergency number.

Publishing of Annual Accident Data

The Committee noted that according to DIMTS' Audit Report, data was not being compiled in the format prescribed by MoRTH. The Committee directed that the State should take steps for recording data in the format prescribed by MoRTH, analysis of the data and generation of reports through computerized data entry and make the data and the reports public, every year, in a book form for the information of all stakeholders. The data for the year 2018 should be published by 14th August, 2019. A copy of the data and the report should be submitted to the Committee.

Implementation of DIMTS Audit Report

The Committee perused the status of achievements of targets set by the State for itself for the year 2018 for implementation of recommendations made in the DIMTS' Audit Report. The Committee observed that the State is lagging behind in respect of some items for various reasons including availability of land and lack of funds. The Committee directed that the progress of achievement of targets for the year 2018 and 2019 should be regularly reviewed at the level of Chief Secretary and the problems being faced by various stakeholder Department/Agencies in achieving the targets including provision of funds should be sorted out under intimation to the Committee. Where ever necessary, targets should be re-fixed/rescheduled and achievements monitored at the level of Chief Secretary.

Annual targets and strategy for reduction of fatalities: Establishment of administrative mechanism at District level

a) Targets: The Committee notes that the State had set a uniform target of reduction in fatalities by 10% for all districts for 2019 and directs that separate targets should be set for each district on the basis of (i) absolute number of fatalities in the district; (ii) its percent growth over previous year; and (iii) number of fatalities on Vulnerable Road Segments and Black Spots in the district.
b) Strategy: The Committee observes that 10510, 10465, 10,444 and 10320 fatalities in 2015, 2016, 2017 and 2018 respectively and the increase in road accident fatalities in the State by 2.34% in January —September, 2019 period, over the previous year, is a matter of serious concern. The Committee further observes that the State Government's strategy for reduction of fatalities has not brought about desirable results and directs that the State should take following action under intimation to the Committee:
(i) Establish an effective administrative mechanism at the District level, initially in ten districts where fatalities were highest, on an average, in 2016, 2017 and 2018 for ensuring a coordinated effort by all stakeholder Departments/agencies for reducing fatalities in these districts; and
(ii) Formulate location specific and district specific strategies for each location and district depending upon the accident & fatality data of the location/district."

State Road Safety Council

The Committee expresses its unhappiness that some Council members did not attend the Council meeting held on 24.06.2019 and directs that the State should ensure that, in future, all members attend the meetings of the Council. The Committee also directs that the State should implement the decisions taken in the State Road Safety Council meeting held on 24.06.2019 and reiterates that the Council should meet at least twice every year to ensure that the stakeholder Department/agencies take necessary measures for road accident and fatality prevention. The minutes of the meetings of the Council together with action taken report should also be forwarded to the Committee regularly.

NHAI: Coordination with State Government

The Committee directs that the NHAI and the State Government should take following action to ensure close coordination between the NHAI, the Lead Agency and the State Nodal Departments/stakeholders:
i) NHAI should ensure that a senior officer, responsible for matters pertaining to all NHAI roads in the State/District, attends the State Road Safety Council and the District Road Safety Committee meetings.
ii) The State/Lead Agency should bring to the notice of Chairman (NHAI) all issues pertaining to NHAI which remain unresolved through the State Road Safety Council and District Road Safety Committee mechanism. Issues still remaining unresolved should be brought to the notice of the Committee.

District Road Safety Committees

a) It appears that all DRSCs have not met regularly in 2019. The Committee again directs that the State should ensure that all DRSCs meet at least once in every quarter.
b) The Committee notes that the State has directed all District Collectors cum Chairpersons of DRSCs to take action on Committee's directions and directs that the Lead Agency should confirm that all DRSCs have analyzed the accident and fatality data of the district; identified all vulnerable road segments (in addition to Black Spots); prepared District Road Safety Action Plans and have started implementation of the Plans as directed by the Committee earlier.

Crash investigations

The Committee directs that the draft scheme prepared by the State under Section 135 of Motor Vehicles Act should also prescribe the parameters for providing such amenities e.g. wayside amenities, truck parking facilities etc. The Committee desires that the draft scheme should accordingly be revised and notified under intimation to the Committee.

Enforcement of traffic laws

The Committee observes that the enforcement of traffic laws in the State continues to be poor and reiterates following directions: a) Road segments prone to traffic violations should be identified in all districts and classified according to the type(s) of violation(s) e.g. straight roads in open/rural areas will be prone to over speeding etc and location specific enforcement measures should accordingly be taken.
b) District wise targets for ensuring compliance with traffic laws, separately for city and rural areas, should be set.
c) Decisions taken in the State Road Safety Council meeting held on 24.06.2019 regarding enforcement should be strictly implemented.
d) Committee's directions dated 18th August, 2015 and 17th November, 2015 to deal with the violation of laws relating to helmet/seat belt, use of mobile phones and dangerous driving etc should be strictly implemented in all districts.

Street lights on NHs, SHs and MDRs

The Committee observes that often accidents happen on NHs, SHs and MDRs in rural areas where there is no street light particularly near inhabited areas. The Committee directs that the road owning agencies should install street lights on NHs, SHs and MDRs at vulnerable locations in rural road segments particularly near inhabited areas and keep them lit/illuminated during night time and ensure patrolling at vulnerable locations to reduce night time road accidents and fatalities on these stretches.

Procurement of equipment to detect traffic violations

The Committee notes that the Police Department is procuring equipments as per BPR&D norms. The Committee desires that the State should intimate (a) the details of equipments required as per BPR&D norms; (b) equipments presently available with the State; and (c) the gap between (a) and (b).

Training of personnel and maintenance of equipment

The Committee notes that the State has not confirmed, as directed by the Committee, that all the personnel presently handling the equipments have been trained in their use and that satisfactory arrangements/AMC for maintenance of equipment presently available in all districts has been made. Audit of the roads most prone to accidents

The Committee desires that the Lead Agency should verify and confirm that all Vulnerable Road Segments (in addition to Black Spots) where accidents occurred the most in 2017 and 2018 have been identified by PWD, RIDCOR. RSRDCC, UDH, LSG & NHAI on roads under them and identify sensitive road segments which have not yet been audited and prepare an action plan, with year wise targets, for initiation & completion of road safety audit and implementation of the recommendations of the audit of all Black Spots and Other Vulnerable Road Segments in consultation with the concerned road owning agencies and monitor the implementation of recommendations of the audit by them. A copy of the Action Plan should be sent to the Committee.

Mapping of Ambulances

The Committee notes that only 108 ambulances have been mapped and directs that all ambulances, both public and private, should be integrated with automatic vehicle location and tracking system, GIS and GPS for mapping/locating the ambulances so that all such ambulances are accessible by common emergency number 108.

Publishing of Annual Accident Data

The Committee appreciates that the State has published a booklet 'Road Accidents In Rajasthan - 2018' containing the road accident data of the State for 2018 and its analysis. The Committee desires that the State should take following action:
a) Booklet for 2019 should be published by 31st October, 2020. A separate chapter on 'The Way Forward' indicating what each stakeholder Department/Agency proposes to do during the financial year 2021 - 2022 should also be included in the Booklet for 2019.
b) The accident and fatality data for the year 2019, compiled in the formats prescribed by MoRTH, should also form part of the 'Road Accidents In Rajasthan - 2019' when the same is published.
c) Similar Road Safety Profile of each district for 2018 should be prepared and uploaded on the website of the District Collectors cum Chairpersons of DRSCs by 28th February, 2020. The District Road Safety Profiles should also contain a list of all Black Spots and other Vulnerable Road Segments in the district and the causes of their vulnerability to guide all stakeholders in policy formulation and plan necessary interventions.
d) Take steps to computerize the data entry and analysis report generation.

Implementation of DIMTS' Audit Report

The Committee directs that the State should regularly review, at the level of Chief Secretary, the progress in implementation of recommendations made by DIMTS and the problems being faced by various stakeholder Department/Agencies in achieving the targets including provision of funds should be sorted out and implementation of the recommendations in the entire State should be ensured.
